1. Acceptance of Terms

Welcome to InkWear ("we," "us," "our," "Website"). By accessing or using our website at https://inkwear.in (the "Site") and purchasing our custom design apparel ("Products"), you ("User," "you," "your") agree to be bound by these Terms and Conditions ("T&C") and our Privacy Policy.

If you do not agree to all of these terms, you are not authorized to use this Site or purchase our Products. These T&C constitute a legally binding agreement between you and InkWear.

2. Eligibility

You must be at least 18 years of age to purchase Products from our Site. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

3. Account Registration and Security

a. You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during the registration process.
b. You are responsible for safeguarding your account password and for all activities that occur under your account.
c. You must notify us immediately of any unauthorized use of your account.

4. Products and Customization

a. Custom Designs: We specialize in custom-designed apparel. You may upload your own designs, text, or images ("User Content").
b. Your Responsibility: You are solely responsible for the User Content you submit. You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize us to use the User Content for printing and fulfillment of your order. You must ensure your User Content does not:
* Infringe any third-party intellectual property (copyright, trademark, patent).
* Be defamatory, obscene, pornographic, or offensive.
* Promote violence, hatred, or illegal activities.
* Violate any applicable law.
c. Our Right to Refuse: We reserve the right, at our sole discretion, to refuse to print or fulfill any order that contains User Content we deem inappropriate, offensive, or potentially infringing, without liability to you.
d. Product Representation: We strive to display the colors, designs, and details of our Products as accurately as possible. However, due to limitations of monitor displays and printing processes, there may be slight variations between the product images on the Site and the actual Product you receive.

5. Orders and Payment

a. Order Acceptance: Your order constitutes an offer to purchase our Products. We reserve the right to accept or decline your order for any reason, including limitations on quantities, inaccuracies in product information, or problems identified by our credit and fraud avoidance department.
b. Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of all applicable taxes, unless stated otherwise. We reserve the right to change prices at any time without prior notice.
c. Payment: Payment must be made in full at the time of order placement through the available payment gateways (e.g., Credit/Debit Cards, UPI, Net Banking). By providing payment information, you represent that you are authorized to use the chosen payment method.

6. Shipping and Delivery

a. Shipping Areas: We currently ship within India.
b. Delivery Timelines: The estimated delivery time is provided on the product page and during checkout. These are estimates and not guaranteed dates. We are not liable for delays caused by courier partners, weather conditions, or unforeseen circumstances.
c. Title and Risk: The risk of loss and title for the Products pass to you upon our delivery to the courier service.

7. Returns, Refunds, and Exchanges

Due to the custom and personalized nature of our Products, we do not accept returns or exchanges unless the product you receive is defective, damaged, or significantly different from what you ordered.

a. Defective or Damaged Goods: If you receive a defective or damaged product, you must notify us within 7 days of delivery. Please provide clear photographs and a description of the issue. We will investigate and, at our discretion, offer a replacement or a full refund.
b. Wrong Product Shipped: If we shipped the wrong product (non-custom), we will arrange for a return and replacement at our cost.
c. Refund Processing: Approved refunds will be processed to the original method of payment within 7-14 working days.

8. Intellectual Property

a. Our IP: All content on this Site, including but not limited to logos, trademarks, text, graphics, and software, is the property of InkWear or its licensors and is protected by Indian copyright and trademark laws.
b. Your IP: The intellectual property rights in your custom User Content remain with you. However, by submitting User Content, you grant InkWear a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify the content solely for the purpose of fulfilling your order (e.g., printing on the apparel).
c. Prohibition: You may not copy, reproduce, or use any of our intellectual property without our express written permission.

9. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site.

10. Limitation of Liability

To the fullest extent permitted by applicable law in India, InkWear, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from:

  • Your use or inability to use the Site.

  • Any Products purchased or obtained through the Site.

  • Unauthorized access to or alteration of your transmissions or data.

  • Statements or conduct of any third party on the Site.

Our total cumulative liability to you for all claims arising from your use of the Site or Products shall not exceed the total amount you paid to us for the specific Product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless InkWear and its affiliates from any claim, demand, damage, or loss (including reasonable attorneys' fees) made by any third party due to or arising out of:
a. Your breach of these T&C.
b. Your violation of any law or the rights of a third party.
c. The User Content you submit.

12. Governing Law and Dispute Resolution

a. Governing Law: These T&C shall be governed by and construed in accordance with the laws of the Republic of India.
b. Jurisdiction: The courts in Bangalore, Karnataka, India shall have exclusive jurisdiction over any disputes arising under these T&C.
c. Dispute Resolution: In the event of any dispute, the parties shall first attempt to resolve it through good-faith negotiations. If the dispute is not resolved, it shall be referred to arbitration by a single arbitrator appointed by InkWear. The arbitration shall be conducted in Bangalore, Karnataka, in accordance with the Arbitration and Conciliation Act, 1996. The arbitral award shall be final and binding.

13. Termination

We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason, including if you breach these T&C.

14. Changes to Terms

We reserve the right to modify or replace these T&C at any time at our sole discretion. The updated version will be posted on the Site with a revised "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the new T&C.
